ยง 50-c. Discrimination based upon history of cancerous condition
prohibited. 1. Neither the state civil service department nor any
municipal commission may refuse to examine an applicant or, after
examination, to certify an individual who has been placed on a certified
eligible list, nor shall such person be deemed to be unfit for the
performance of the duties of a position solely because such person has a
history of cancer, provided such person is able to perform in a
reasonable manner the activities involved in the position sought or
held.
2. Nothing contained in this section shall be construed to limit the
scope of section two hundred ninety-six of the executive law.
3. A violation of this section shall be considered an unlawful
discriminatory practice and, notwithstanding any other provision of law,
any complaint about such violation shall be subject to the procedures
set forth in section two hundred ninety-seven of the executive law.
