ยง 76-b. Equipment required on motor vehicles transporting railroad
employees; penalty. 1. Every motor vehicle provided by the owner or
operator railroad and used to transport employees shall be equipped with
adequate seating facilities, heating facilities and facilities for
communication between occupants of the front seat of the vehicle and the
occupants in the rear compartment of the vehicle. This requirement shall
not apply to motor vehicles used to transport employees at distances of
less than five miles from their regular assembly point nor in cases of
extreme emergency.

2. If any dispute arises as to the adequacy of the facilities provided
for in this section, it shall be submitted to the commissioner of
transportation for a fair hearing. Notice of the hearing may be given by
mailing the notice of hearing to the owner or operator railroad.
Attendance of witnesses may be compelled by subpoena. If the
commissioner finds that a violation of this section has occurred, he may
forward his findings and recommendations to the commissioner of motor
vehicles.
