ยง 206. Highways in lands acquired by the United States for
fortification purposes deemed abandoned. When land sought to be acquired
by the United States of America for the purpose of fortifications
includes a highway or portion thereof, the condemnation proceedings may
include such highways or portion thereof, and the people of the state of
New York, any municipality, county or other party claiming an interest
therein may be made a party defendant in such proceeding, and the
interest of the state, county, municipality or other claimant be
determined, and the award made therefor. Forthwith upon the acquisition
by the United States of America of land which includes a highway or
portion thereof, there shall be filed in the office of the town clerk of
the town, and also in the office of the county clerk of the county, in
which such land is located, certified copies of the record or transfer
to the United States of such land, together with a map of such land, on
which map such highway or portion thereof shall be indicated by metes
and bounds, and thereupon such highway or portion thereof shall be
deemed discontinued and abandoned for highway purposes, and if
proceedings have been taken, pursuant to this chapter for the
improvement of such highway by state aid, all such proceedings, together
with any appropriation made for the improvement of such highway or
portion thereof, as indicated on such map, shall be deemed revoked,
vacated and set aside.
