The division or the commission may:
A. sue and be sued, issue subpoenas and compel the attendance of witnesses and the production of documents, records and physical exhibits in any hearing;
B. administer oaths;
C. adopt and use a seal for authentication of its records, processes and proceedings;
D. compel minimum code compliance in all certified code jurisdictions and political subdivisions; and
E. investigate code violations in any code jurisdictions in New Mexico.

Enforcement of state building code. — The construction industries division of the regulation and licensing department has the authority to refuse to provide inspection services or certify local inspectors in municipalities that fail to adopt a building code that provides for minimum requirements of the state Uniform Building Code. The construction industries division has the authority to issue a stop work or similar order on a construction project authorized by a local jurisdiction that has adopted a building code that, while the code meets minimum standards set by the CID, differs from the building code adopted by CID. 2011 Op. Use of appropriated funds under former law. — The contractors' license board (now abolished) may not spend money from the appropriated funds for the construction of a block wall contingent upon the board's failure to exercise the right of option to purchase said property. 1958 Op.
