The Department of Banking and Finance may bring an appropriate civil action to enforce any provision of this chapter whether by injunction or otherwise in any superior court of this state having jurisdiction over one or more defendants.

The 2020 amendment, effective June 30, 2020, deleted “or the Industrial Loan Commissioner” following “Finance” in the first sentence and deleted the former second and third sentences, which read: “In the case of a loan made pursuant to this chapter by a licensee under Chapter 3 of this title, relating to industrial loans, such action shall be brought by the Industrial Loan Commissioner. In the case of any other loan, the action shall be brought by the Department of Banking and Finance.
