§ 33-64-2. License Requirements and Filing Fees

The 2019 amendment, effective July 1, 2019, in subsection (l), deleted “hospital service corporation, medical service corporation,” following “health care center,” twice in the first sentence and once in the second sentence.
The 2020 amendments. —
The first 2020 amendment, effective July 1, 2021, in subsection (b), substituted “$2,000.00” for “$500.00” and “$1,000.00” for “$400.00”; deleted “and shall not be suspended or revoked” following “renewed” near the beginning of subsection (c); deleted “or” at the end of paragraph (c)(3); substituted “; or” for the period at the end of paragraph (c)(4); and added paragraph (c)(5); substituted “business entity” for “nonaffiliated business entity unless a special authorization is approved by the Commissioner prior to entering into a contracted or subcontracted arrangement” at the end of subsection (h); in subsection (i), substituted “$2,000.00” for “$1,000.00” and substituted “$10,000.00” for “$5,000.00”; in subsection (k), in the first sentence, substituted “shall subject” for “may subject”, substituted “$2,000.00” for “$1,000.00”, substituted “shall be” for “may be” and substituted “$10,000.00” for “$5,000.00”, and added the last sentence; and deleted former subsection (l), which read: “A pharmacy benefits manager operating as a line of business or affiliate of a health insurer, health care center, or fraternal benefit society licensed in this state or of any affiliate of such health insurer, health care center, or fraternal benefit society shall not be required to obtain a license pursuant to this chapter. Such health insurer, health care center, or fraternal benefit society shall notify the Commissioner annually, in writing, on a form provided by the Commissioner, that it is affiliated with or operating as a line of business as a pharmacy benefits manager.” The second 2020 amendment, effective July 1, 2021, made identical changes. Ga. L. 2020, p. 768, § 9(a)/HB 946 and Ga. L. 2020, p. 780, § 9(a)/SB 313, not codified by the General Assembly, provide, in part, that the amendment by that Act shall apply to all contracts issued, delivered, or issued for delivery in this state on and after July 1, 2021.
