Article 2 - Powers, Duties and Jurisdiction of the Department of Transportation
14-G - Intercity Bus Passenger Service Preservation.

ยง 14-g. Intercity bus passenger service preservation. 1. Authorization
is hereby given to the commissioner of transportation to contract with
any person, firm, corporation or agency, including, but not limited to,
any intercity bus company, state agency, the federal government, any
other state or agency or instrumentality thereof, any public authority
of this state or any other state, or any political subdivision or
municipality of the state, for the purpose of providing, maintaining and
improving intercity bus passenger service within New York state.

2. The commissioner may, subject to the concurrence of the director of
the budget:

a. Enter into joint service agreements on behalf of the state with any
intercity bus company, the federal government, any other state or agency
or instrumentality thereof, any public authority of this state or any
other state, or any political subdivision or municipality of the state,
relating to property, buildings, structures, facilities, equipment,
services, rates, fares, allowances or charges, or rules or regulations
pertaining thereto, for or in connection with the provision of intercity
bus passenger services, or such local or commuter services as are
provided by an intercity bus company.

b. Utilize federal moneys available or which may become available to
the state for the purpose of effectuating the provisions of this
section, and enter into any necessary agreements required to meet
federal regulations, criteria and standards in connection therein.

c. Do all things necessary, convenient or desirable to carry out the
purposes of this section.

3. For the purposes of this section, the term "intercity bus passenger
service" shall mean transportation provided to the public on a regular
and continuing basis by a person, firm, or corporation authorized to
transport passengers in interstate commerce by the United States
department of transportation or in intrastate commerce by the state
department of transportation that is primarily intended to satisfy
longer distance travel demand between cities, and villages and
unincorporated urban places that have a population of two thousand five
hundred or more. Such term does not include services that are primarily
local or commuter oriented in nature.
