Chapter 38.5. Broadband Grants for Rural Areas
4-4-38.5-3. "Eligible Broadband Service"

Sec. 3. As used in this chapter, "eligible broadband service" means a connection to the Internet that provides an actual speed of at least:
(1) one thousand (1,000) megabits per second downstream with respect to grants awarded under section 9(b)(1) or 9(b)(2) of this chapter; or
(2) fifty (50) megabits per second downstream and at least five (5) megabits per second upstream with respect to grants awarded under section 9(b)(3) or 9(b)(4) of this chapter;
regardless of the technology or medium used to provide the connection.
