The Commissioner of Public Health may waive any provisions of the regulations applying to an emergency medical service organization or emergency medical services personnel, as such terms are defined in section 19a-175, if the commissioner determines that such waiver (1) would not endanger the health, safety or welfare of any patient or resident, and (2) does not affect the maximum allowable rates for each emergency medical service organization or primary service area assignments. The commissioner may impose conditions, upon granting the waiver, that assure the health, safety or welfare of patients or residents and may terminate the waiver upon a finding that the health, safety or welfare of any patient or resident has been jeopardized. The commissioner may adopt regulations, in accordance with the provisions of chapter 54, establishing procedures for an application for a waiver pursuant to this subdivision.
