Section 45-51-72 - Board of Revenue.

(a) There is established a board consisting of five persons, to be called the Board of Revenue of Montgomery County.
(b) The members of the board shall be appointed by the Governor, and shall hold their office for the term of four years, and until their successors are qualified, and in case of a vacancy the same shall be filled by the Governor, upon certificate of such vacancy by the remaining members of the board.
(c) The board shall have power and authority to direct and control the property of the county as it may deem expedient, according to law; to levy a general tax for general, and a special tax for particular county purposes, according to the provisions of this code; to examine, settle, and allow all accounts and claims chargeable against the county; to examine and audit the accounts of all officers having the care, management, collection, or disbursement of money belonging to the county, or appropriated for its use and benefit; to have exclusive control of the convict labor of the county and the disbursement of the proceeds of the same; and the sole right and authority to bind the County of Montgomery on any contract for the payment of money.
(d) The board shall exercise the same supervising control over the tax collector and tax assessor of the county, their bonds, and removal from office, as is now required by law of the commissioners court of the county.
(e) The board shall have exclusive jurisdiction of the matter of insolvencies and errors in the assessment and collection of the taxes as is now exercised by the commissioners court of the county.
(f) The board shall have power and authority to compromise the outstanding debt of Montgomery County; to examine into and pass upon the legality of warrants already issued; to classify and register outstanding warrants, and may pledge the credit of the county to raise money to discharge the same.
(g) The board shall elect one of its members to be presiding officer when in session, and who shall determine all matters in the event of a tie in the vote of the other members, and who shall sign the minutes of the proceedings of the board. And the board shall also elect another member as clerk, who shall keep an office at or near the court house of the county, and whose duty it shall be to receive and prepare business and obtain information for the sessions of the board, and to see to the execution of all orders thereof, and to report to the board all infractions of the revenue law in the county, of which he or she can obtain authentic information, to keep proper records of the proceedings of the board in well bound volumes, provided for that purpose, and which shall always be open to the inspection of the citizens of the county, and generally to do and perform such matters as may be required of him or her by the board. The board, at any time, may change its president or clerk.
(h) The Montgomery County Commission shall hold four sessions annually, viz: on the second Monday of February and April and November, and on the third Monday in August, and may hold a special session at any time upon the call of the chair or any two members of the commission. Notice of special sessions shall be given to a newspaper published in the City of Montgomery.
(i) A majority of the board shall constitute a quorum for the transaction of business, and no funds belonging to the county shall be drawn, except as authorized by the board, and a proper list and registry of all sums drawn, and of the nature of the claim, and of the person in whose favor drawn, shall be kept by the clerk of the board.
(j) The clerk of the board shall receive for his or her services a salary of not less than one thousand dollars ($1,000) nor more than fifteen hundred dollars ($1,500), according to the extent of his or her usefulness, to be determined by the other members of the board; and the other members of the board shall be allowed two dollars ($2) per diem while in session, and mileage at the rate of five cents ($.05) per mile to and from the place of meeting, the whole compensation in no case to exceed the sum of one hundred dollars ($100) per annum to any of such members.
(k) It shall be the duty of the clerk of each court in the county, and of the register in chancery, to render to the board, within 10 days after the adjournment of the court, a list, under oath, of all fines and forfeitures taken during such term for the use of the county, and of all taxes upon cases decided at such term.
