§ 35. Proceedings in court. If it appear after an investigation or
hearing conducted as herein provided that any person, association or
corporation is guilty of a violation of the provisions of this chapter
or of any other act the enforcement of which is within the jurisdiction
of the department, an action or proceeding may be instituted in a court
of competent jurisdiction to recover a penalty for such violation or to
compel a compliance with such provisions, or prevent a continuance of
such violations.
