ยง 314. Claim filing. The right to compensation including medical care
and funeral expenses under the provisions of this article shall be
barred unless written claim is filed with the chairman within ninety
days after injury or, if death results therefrom, within ninety days
after death; except that if death shall occur more than one year after
the injury, the right shall be barred unless prior written claim based
on the injury has been timely filed. If disability or death is caused by
a disease that is included among the diseases enumerated in section
forty, then the claim may be filed within the time and in the manner
provided in section forty.
Failure to file written claim as required may be excused by the
chairman on the ground that, for good and sufficient reason, claim could
not be filed on time.
