ยง 2994-t. Regulations. 1. The commissioner shall establish such
regulations as may be necessary to implement this article.
2. The commissioner, in consultation with the commissioners of the
office of mental health and the office for people with developmental
disabilities, shall promulgate regulations identifying the credentials
of health care professionals qualified to provide an independent
determination, pursuant to subdivision three of section twenty-nine
hundred ninety-four-c of this article, that a patient lacks
decision-making capacity because of mental illness or developmental
disability.
