1. Pursuant to The Federal Clean Air Act, 42 U.S.C. section 7543
(e)(2)(b) as amended by Public Law 101-549, November fifteenth, nineteen
hundred ninety, within one year from the effective date of this section,
the commissioner shall adopt regulations which are consistent with the
California air emissions reduction and labeling regulations for new
spark ignition marine engines for use in personal watercraft. Such
regulations shall apply to every new personal watercraft that is
manufactured for sale or offered for sale in New York. The commissioner
shall review and revise such regulations annually in order to retain
their consistency with the California air emissions and labeling
regulations for spark ignition marine engines.
2. For purposes of this section, the term "personal watercraft" shall
have the same meaning as in subdivision thirty of section two of the
navigation law.
