Article 6 - Administration and Judicial Review
Section 58-13C-609 - Judicial review.

A. A final order issued by the director pursuant to the New Mexico Uniform Securities Act is subject to judicial review in accordance with the provisions of Section 39-3-1.1 NMSA 1978.
B. The filing of an appeal pursuant to Subsection A of this section does not, unless specifically ordered by the court, operate as a stay of the director's order or rule, and the director may enforce or ask the court to enforce the order pending the outcome of the review proceedings.

Effective dates. — Laws 2009, ch. 82, § 704 made the New Mexico Uniform Securities Act effective January 1, 2010.
Corporation commission (now public regulation commission) not authorized to issue sales permit. — The authority of the corporation commission (now public regulation commission) to review a decision of the chief as to the issuance of a permit to sell securities did not constitute authorization for the corporation commission (now public regulation commission) to issue a permit which had been approved by the chief pursuant to former Section 58-13-10 NMSA 1978. Unless an aggrieved party appealed, the corporation commission (now public regulation commission) had no basis for exercising any authority with respect to a decision of the chief. 1981 Op.
