Chapter 304 - Election of United States Senators and Representatives

In case of a vacancy in the office of United States Senator caused by death, resignation or otherwise, the Governor may appoint some qualified person to fill the vacancy, who shall hold office until the next general election and until his or her successor shall be elected and seated.

In case of a vacancy in the office of United States Senator caused by death, resignation or otherwise, the Governor may appoint some qualified person to fill the vacancy who is a member of the same political party as the former Senator and was a member of that party for at least 90 days immediately preceding the creation of the vacancy, who shall hold office until the next general election and until his or her successor shall be elected and seated.
