Section 16. (a) Except as otherwise provided in subsection (b), a person who for valuable consideration, knowingly purchases or sells a part for transplantation or therapy if removal of such part from an individual is intended to occur after the individual's death shall be punished by imprisonment in the state prison for not more than 5 years or in the house of correction for not more than 2.5 years, or by a fine of not more than $50,000 or by both such fine and imprisonment.
(b) A person may charge a reasonable amount for the removal, processing, preservation, quality control, storage, transportation, implantation, or disposal of a part.
