Sec. 1.
Short title.
This Act shall be known and may be cited as the
Degradable Plastic Act.

Sec. 2. Definitions. As used in this Act, the following terms shall
have the meanings indicated, unless the context otherwise requires:
"Agency" means the Illinois Environmental Protection Agency.
"Department" means the Department of Commerce and Economic Opportunity.
"Degradable" means capable of disintegrating, by naturally occurring
biological or physical processes in the environment within a period of 3
years after disposal, into fragments that are small relative to the
original size, or into particles of a molecular weight that is low when
compared to the molecular weight of the original material.
"Plastic container" means a package, bag, bottle, cup, wrapping,
blister-pack or other device that is made of plastic, plastic-coated paper,
or other synthetic polymeric material, and is used to contain or protect
merchandise ultimately intended for retail sale, or to contain waste for
disposal.
"Recyclable plastic container" means a container composed entirely
(exclusive of any readily detachable lid, closure, handle or label) of one
type of plastic for which the Department finds that there exists an
effective recycling market in this State.

Sec. 5.
State purchasing.
The Department of Central Management
Services, and all other departments and agencies of State government, when
purchasing plastic containers and other plastic products, shall purchase
products that are degradable or recyclable whenever such products are
available at reasonable cost and in the appropriate quantity and quality.
