Sec. 0.01.
Short title.
This Act may be cited as the
University of Illinois Hospital Act.

Sec. 1.
"University" means The Board of Trustees of the University of
Illinois. "University of Illinois Hospital" means any hospital, institute,
clinic, outpatient department or office owned or leased by the University
at which a University health care program is conducted. "University health
care program" means a patient diagnostic, treatment or care program, service
or activity conducted by the University through its personnel it assigns
to such programs in furtherance of the University's teaching, research and
public service functions. The health professional colleges of the University
of Illinois may be operated in
conjunction with the University of Illinois Hospital or any University
health care program to such extent as may be deemed practicable.

Sec. 2.
The general management, control and operation of the University of
Illinois Hospital shall be in the University.

Sec. 3.
The University may provide for a managing officer for the
University of Illinois Hospital and prescribe his duties and compensation.

Sec. 4.
The University may make expenditures for buildings and other
improvements from appropriations made to the university, which buildings and
improvements are upon land the control and legal title to which is in the
State of Illinois rather than in the University. Control of buildings
erected on such land shall be in the University.
For each dollar of expense incurred by the University of Illinois in
providing unreimbursed health care to indigent patients, the State shall
reduce the amount of the University's repayment obligation to the State by one dollar.
Gifts for the University of Illinois Hospital may be received and shall
be administered in accordance with the terms of the gift.

Sec. 5.
The University may establish and collect charges for hospital
services rendered in the University of Illinois Hospital or in connection
with a University health care program. However, with
respect to health care professional services rendered in connection with
a University health care program at the University
of Illinois Hospital or elsewhere by the
Doctors of Medicine, the Doctors of Dentistry, or other health
care
professionals who are members of the University
faculty,
charges for such professional services shall not be established or
collected by the University or the University of Illinois Hospital but may
be by said members of said faculty who render such services under a
plan or plans organized and administered by them. All such charges shall be
deposited in a special fund or funds in the treasury of the University. The
billing, collecting and disbursing of any such fund shall remain
exclusively under the supervision and control of such faculty under a
plan or plans established by them for the general benefit and support of
University programs and activities related to the health professions, provided
no charges may be
made or collected until such plan has been approved by the University.
However, no person shall make or collect a personal or professional
charge for his own account for treating, caring for or nursing a
patient in the University of Illinois Hospital
(other than health care professional services provided at the University of
Illinois Hospital by
non-salaried
adjunct
University faculty who are licensed dentists or physicians licensed to
practice medicine in all its branches
members)
or in connection with a
University
health care program. Nothing herein shall prevent the University from approving
a plan under which any such fund in the University treasury may be utilized
in paying the University salaries of such faculty members, or from assisting
in the billing and collection of professional charges if all University
costs in connection therewith are paid from the charges so collected.

Sec. 6.
No otherwise qualified child with a disability receiving special education
and related
services under Article 14 of The School Code shall solely by reason of his
or her disability be excluded from the participation in or be denied the benefits
of or be subjected to discrimination under any program or activity provided
by the University of Illinois Hospital.

Sec. 6.5. List of individuals that may not be admitted for treatment prohibited. The University of Illinois Hospital may not maintain a list of individuals that may not be admitted for treatment at the University of Illinois Hospital. Nothing in this Section shall be construed to prohibit the University of Illinois Hospital or a member of the University of Illinois Hospital's medical staff from recommending an alternate provider, coordinating an appropriate transfer, or arranging access to care services that best meets the needs of an individual patient.

Sec. 6.7. Health insurance marketplace notices. The University of Illinois Hospital shall post, in each facility that has an emergency room, a notice in a conspicuous location in the emergency room with information about how to enroll in health insurance through the Illinois health insurance marketplace in accordance with Sections 1311 and 1321 of the federal Patient Protection and Affordable Care Act.

Sec. 7. Prevention and control for Multidrug-Resistant Organisms. The University of Illinois Hospital shall develop and implement comprehensive interventions to prevent and control multidrug-resistant organisms (MDROs), including methicillin-resistant Staphylococcus aureus (MRSA), vancomycin-resistant enterococci (VRE), and certain gram-negative bacilli (GNB), that take into consideration guidelines of the U.S. Centers for Disease Control and Prevention for the management of MDROs in healthcare settings. The Department of Public Health shall adopt administrative rules that require the University of Illinois Hospital to perform an annual facility-wide infection control risk assessment and enforce hand hygiene and contact precaution requirements.

Sec. 8. Immunization against influenza virus and pneumococcal disease. The University of Illinois Hospital shall adopt an influenza and pneumococcal
immunization policy that includes, but need not be limited to, the

Sec. 8b. Instruments for taking a pregnant woman's blood pressure. The University of Illinois Hospital shall ensure that it has the proper instruments available for taking a pregnant woman's blood pressure. The Department of Public Health shall adopt rules for the implementation of this Section.

Sec. 8c. Closed captioning required. The University of Illinois Hospital must make reasonable efforts to have activated at all times the closed captioning feature on a television in a common area provided for use by the general public or in a patient's room or to enable the closed captioning feature when requested to do so by a member of the general public or a patient if the television includes a closed captioning feature.
It is not a violation of this Section if the closed captioning feature is deactivated by a member of the University of Illinois Hospital's staff after such feature is enabled in a common area or in a patient's room unless the deactivation of the closed captioning feature is knowing or intentional. It is not a violation of this Section if the closed captioning feature is deactivated by a member of the general public, a patient, or a member of the University of Illinois Hospital's staff at the request of a patient of the University of Illinois Hospital.
If the University of Illinois Hospital does not have a television that includes a closed captioning feature, then the University of Illinois Hospital must ensure that all televisions obtained for common areas and patient rooms after January 1, 2020 (the effective date of Public Act 101-116) include a closed captioning feature. This Section does not affect any other provision of law relating to disability discrimination or providing reasonable accommodations or diminish the rights of a person with a disability under any other law.
As used in this Section, "closed captioning" means a text display of spoken words presented on a television that allows a deaf or hard of hearing viewer to follow the dialogue and the action of a program simultaneously.

Sec. 8d. N95 masks. Pursuant to and in accordance with applicable local, State, and federal policies, guidance and recommendations of public health and infection control authorities, and taking into consideration the limitations on access to N95 masks caused by disruptions in local, State, national, and international supply chains, the University of Illinois Hospital shall provide N95 masks to physicians licensed under the Medical Practice Act of 1987, registered nurses and advanced practice registered nurses licensed under the Nurse Licensing Act, and any other employees or contractual workers who provide direct patient care and who, pursuant to such policies, guidance, and recommendations, are recommended to have such a mask to safely provide such direct patient care within a hospital setting. Nothing in this Section shall be construed to impose any new duty or obligation on the University of Illinois Hospital or employee that is greater than that imposed under State and federal laws in effect on the effective date of this amendatory Act of the 102nd General Assembly.
This Section is repealed on July 1, 2022.

Sec. 8e. Facility-provided medication upon discharge.
(a) The General Assembly finds that this Section is necessary for the immediate preservation of the public peace, health, and safety.
(b) In this Section, "facility-provided medication" has the same meaning as provided under Section 15.10 of the Pharmacy Practice Act.
(c) When a facility-provided medication is ordered at least 24 hours in advance for surgical procedures and is administered to a patient at the University of Illinois Hospital, any unused portion of the facility-provided medication must be offered to the patient upon discharge when it is required for continuing treatment.
(d) A facility-provided medication shall be labeled consistent with labeling requirements under Section 22 of the Pharmacy Practice Act.
(e) If the facility-provided medication is used in an operating room or emergency department setting, the prescriber is responsible for counseling the patient on its proper use and administration and the requirement of pharmacist counseling is waived.

Sec. 8f. Surgical smoke plume evacuation.
(a) In this Section:
"Department" means the Department of Public Health.
"Surgical smoke plume" means the by-product of the use of energy-based devices on tissue during surgery and containing hazardous materials, including, but not limited to, bioaerosols, smoke, gases, tissue and cellular fragments and particulates, and viruses.
"Surgical smoke plume evacuation system" means a dedicated device that is designed to capture, transport, and filter surgical smoke plume at the site of origin and before it can diffuse and pose a risk to the occupants of the operating or treatment room.
(b) To protect patients and health care workers from the hazards of surgical smoke plume, the University of Illinois Hospital shall adopt policies to ensure the elimination of surgical smoke plume by use of a surgical smoke plume evacuation system for each procedure that generates surgical smoke plume from the use of energy-based devices, including, but not limited to, electrosurgery and lasers.
(c) The University of Illinois Hospital shall report to the Department within 90 days after January 1, 2022 (the effective date of Public Act 102-533) that policies under subsection (b) of this Section have been adopted.

Sec. 8g. University of Illinois Hospital employee assistance programs. The University of Illinois Hospital shall ensure that employees of the University of Illinois Hospital are aware of employee assistance programs or other like programs available for the physical and mental well-being of the employee. The University of Illinois Hospital shall provide information on these programs, no less than at the time of employment and during any benefit open enrollment period. The University of Illinois Hospital may provide this information to employees electronically.
