§149A-35 Cooperation. The department is authorized and empowered to cooperate with and enter into agreements with any agency of the State, the federal government, or any other agency for the purpose of carrying out this chapter. The University of Hawaii cooperative extension service and other educational agencies shall provide educational programs aimed at assisting users and prospective users of pesticides and shall solicit the aid of the department in providing technical assistance and advice on the authorized use of pesticides. Read in the context of the larger statutory scheme of the Hawaii pesticides law, which clearly demonstrated legislative intent to create a uniform system of pesticide regulation administered by the state department of agriculture, the court interpreted this section as authorizing counties to assist in enforcing pesticide regulations established by the State, and not an authorization for counties to issue supplemental regulations on pesticides. 842 F.3d 669 (2016).
