§ 43-39A-2. Definitions

As used in this chapter, the term:

The 2019 amendment, effective July 1, 2019, added paragraph (1); redesignated former paragraphs (1) through (3) as present paragraphs (2) through (4), respectively; rewrote subparagraph (4)(A); substituted “shall not mean” for “does not include” in subparagraph (4)(B); substituted “that” for “who” twice in division (4)(B)(ii), division (4)(B)(iv), and paragraph (14); deleted “or” at the end of division (4)(B)(iv); inserted “; or” at the end of division (4)(B)(v); added division (4)(B)(vi); deleted former paragraph (4), which read: “ ‘Appraisal management services’ means services performed by an appraisal management company and may include, but are not limited to, such activities as recruiting appraisers, contracting with appraisers to perform real estate appraisal activity, negotiating fees for appraisals, receiving appraisal orders and appraisal reports, and submitting appraisal reports received from appraisers to clients.”; added paragraphs (5) and (6); redesignated former paragraphs (5) through (11) as present paragraphs (7) through (13), respectively; in paragraph (9), substituted “Appraisal Subcommittee of” for “designees of the heads of the federal financial institutions regulatory agencies established by”, and substituted “established pursuant to 12 U.S.C. Section 3310” for “Act of 1978 (12 U.S.C. Section 3301, et seq.), as amended”; substituted “individual” for “person” near the beginning of paragraph (10); rewrote paragraph (12); deleted former paragraph (12), which read: “ ‘Certified appraisal’ or ‘certified appraisal report’ means an appraisal or appraisal report given, signed, and certified as such by a certified real estate appraiser. A certified appraisal or appraisal report represents to the public that it meets the appraisal standards defined in this chapter.”; redesignated former paragraphs (13) through (15) as present paragraphs (14) through (16), respectively; added paragraph (17); redesignated former paragraph (16) as present paragraph (18); added paragraphs (19) through (21); deleted former paragraph (17), which read: “ ‘Evaluation assignment’ means an engagement for which an appraiser is employed or retained to give an analysis, opinion, or conclusion that relates to the nature, quality, or utility of identified real estate or identified real property.”; redesignated former paragraph (18) as present paragraph (22); in paragraph (22), inserted a colon following “transaction which”, designated the existing (A) and (B) as subparagraphs (22)(A) and (22)(B), substituted “A federal” for “a federal” at the beginning of subparagraph (22)(A), substituted “Requires” for “requires” at the beginning of subparagraph (22)(B); added paragraph (23); redesignated former paragraphs (19) through (25.1) as present paragraphs (24) through (31), respectively; substituted “10” for “5” in paragraph (25); rewrote paragraph (26); added paragraphs (32) and (33); redesignated former paragraphs (26) through (28) as present paragraphs (34) through (36), respectively; rewrote paragraph (35); and deleted former paragraph (29), which read: “ ‘Valuation assignment’ means an engagement for which an appraiser is employed or retained to give an analysis, opinion, or conclusion that estimates the value of an identified parcel of real estate or identified real property at a particular point in time.”

Pursuant to Code Section 28-9-5, in 1997, “corporeal” was substituted for “corporal” in paragraph (14) (now (27)).
