Article 72 - Administration of Division
§ 8-72-108. Oaths - Witnesses - Subpoenas


(2) [ Editor's note: This version of subsection (2) is effective March 1, 2022. ] In case of contempt or refusal to obey a subpoena issued to any person, any court of this state within the jurisdiction of which the inquiry is carried on or within the jurisdiction of which said person guilty of contempt or refusal to obey is found or resides or transacts business, upon application by the division or its duly authorized representative, shall have jurisdiction to issue to such person an order requiring him or her to appear before the division or its duly authorized representative to produce evidence if so ordered or give testimony touching the matter under investigation or in question. Any failure to obey such order of the court may be punished by said court as a contempt thereof. Any person who, without just cause, fails or refuses to attend and testify or to answer any lawful inquiry, or to produce books, papers, correspondence, memoranda, and other records, if it is in his or her power so to do in obedience to a subpoena of the division or its duly authorized representative commits a petty offense. Each day such violation continues shall be deemed a separate offense.
