(a) For purposes hereof:
(1) ADDITIONAL PIKE ROAD SCHOOL DISTRICT TAXATION means the levy and collection in the Pike Road school tax district of additional ad valorem school district taxation at the uniform rate of 3 mills pursuant to Amendment 3 to the Alabama Constitution, as increased by 22.5 mills pursuant to Section 217 of the Alabama Constitution to a uniform total rate of 25.5 mills, effective simultaneously with the reduction of 6.5 mills of ad valorem school district taxation in the district (by expiration of a separate ad valorem school district taxation in the district, and for any tax year for which the levy of the additional school district tax at the uniform total rate shall be approved in the manner then provided by law; provided that the additional Pike Road school district taxation to be levied and collected in the district may be levied commencing with the tax year commencing on October 1, 2022, to be collected for the year for which district school taxes become due and payable on October 1, 2023, and thereafter, notwithstand-ing any other provision of this subdivision; provided further, that the net proceeds of the additional Pike Road school district taxation shall be used exclusively for capital outlay purposes to acquire, equip, design, construct, finance, maintain, and repair public school facilities in the Pike Road school district, and for the payment of the principal and interest on indebtedness for those purposes.
(2) ALABAMA CONSTITUTION means the Constitution of Alabama of 1901, as amended.
(3) FAVORABLE MAJORITY VOTE means the approval of the additional Pike Road school district taxation by a majority of the qualified electors of the Pike Road school tax district who vote at a special election to be held in the Pike Road school tax district therefor pursuant to the laws governing special elections.
(4) PIKE ROAD SCHOOL TAX DISTRICT means and includes the area within the corporate limits of the City of Pike Road.
(5) PROPOSAL OF TAXING AUTHORITY means the proposal of the additional Pike Road school district taxation by the Montgomery County Commission, as the taxing authority with respect thereto, by resolution and order adopted upon request of the City Board of Education of the City of Pike Road.
(b) The Legislature, for purposes of Section 217 of the Alabama Constitution and upon adoption of the Proposal of the Taxing Authority, approves the additional Pike Road school district taxation subject to the favorable majority vote.
(c) The Pike Road Superintendent of Education, after approval of the Pike Road Board of Education, shall submit the strategic plan and performance metrics of the Pike Road Board of Education to all members of the state Senate and House of Representatives that represent any part of Montgomery County for review prior to commencement of the next regular session of the Legislature. Thereafter, the Pike Road Board of Education shall annually review and update the strategic plan and the performance metrics as needed, and the Pike Road Superintendent of Education shall submit the revised strategic plan and performance metrics to all members of the state Senate and House of Representatives that represent any part of Montgomery County for review prior to each regular session of the Legislature.
