(a)(1) The sale of draft or keg beer for on-premises consumption only by retail licensees of the Alabama Alcoholic Beverage Control Board is authorized in areas of Montgomery County outside of the corporate limits of the City of Montgomery.
(2) Any sale or condition of sale of draft or keg beer or other alcoholic beverage approved by an ordinance adopted by the City of Montgomery pursuant to subsection (b) or (c), or both subsections, shall automatically be authorized and applicable in the county outside of the corporate limits of the City of Montgomery.
(b) The governing body of the City of Montgomery is hereby empowered to authorize by ordinance the sale of draft or keg beer for on-premises consumption only by retail licensees of the Alabama Alcoholic Beverage Control Board within the corporate limits of the city.
(c)(1) The governing body of the City of Montgomery is hereby empowered to regulate the sale of alcoholic beverages by designating the days and hours during which alcoholic beverages are authorized to be sold at retail within the corporate limits of the city.
(2) The City of Montgomery may adopt any ordinance authorized by this section before October 1, 2003, provided that any ordinance adopted shall apply to the entire city, and provided that no ordinance shall become effective sooner than October 1, 2003.
(d) A licensed club, retail establishment, or other licensee may not repackage keg or draft beer or keg malt beverages for sale. Any keg containing beer or malt beverages shall be identified by number and registered to the buyer.
(e) All laws or parts of laws which conflict with this section are repealed. However, the provisions of this section are cumulative and supplementary and shall not be construed to repeal or supersede any laws or parts of laws not directly inconsistent herewith.
