Section 45-45-172 - Board of Health.

(a)(1) The Madison County Board of Health shall designate the environmental services rendered by the county health department for which fees may be charged and shall set the fee to be charged for each service. The health department may charge and collect the fees pursuant to this section. All fees collected shall be in addition to any and all federal, state, and local appropriations. Any fees collected shall be processed in accordance with the recommendations of the Department of Examiners of Public Accounts.
(2) The board of health shall submit to the Madison County Commission a list of environmental services rendered by the county health department for which a fee is charged pursuant to this section. The commission may repeal or amend any fees set pursuant to this section and shall approve any future increases for environmental services imposed by the board of health.
(3) Fees authorized pursuant to this section shall not exceed the amount necessary to carry out the activities of the corresponding environmental service for which each fee is collected.
(b) This section shall not apply to nor affect any fees otherwise authorized, set, or collected under state or federal law or regulations.
(c) All fees collected pursuant to this section are hereby continuously appropriated to the Madison County Board of Health which collected the fees. The fee collected shall be appropriated within the department performing the service for which the fee was paid.
(d) The county health department shall act upon any application for a permit to have an on-site sewage disposal or septic system within 15 working days from the date the application was submitted. If the department does not approve the application, the department shall contact the applicant within 15 working days with the reasons for the denial and the recommendations for remedies.
