Section 45-23A-90.01 - Regulation of Sale and Consumption of Alcoholic Beverages on Sunday.

(a) The sale of alcoholic beverages on Sundays may be authorized by the city council within the corporate limits of the City of Ozark in Dale County subject to approval by a referendum as provided in this section. If the Sunday sale of alcoholic beverages is approved by the referendum, the city council of the city, by ordinance, may permit the sale and consumption of alcoholic beverages subject to the referendum as determined by the city council by properly licensed retail licensees of the Alcoholic Beverage Control Board serving the general public. Pursuant to authority granted pursuant to the referendum, the city council may regulate which retail licensees may sell alcoholic beverages on Sunday, whether the sale may be for on-premises or off-premises consumption, or both, and any other aspect of the Sunday sale of alcoholic beverages.
(b) The city shall hold a referendum to determine whether to grant authority to the city council to provide for the sale of alcoholic beverages on Sunday pursuant to the authority specified in the referendum. The referendum shall specify whether the authority granted to the city council would include the sale of alcoholic beverages on Sundays for on-premises consumption and the time the sale of alcoholic beverages for on-premises consumption may commence and whether the authority granted to the city council would include the sale of alcoholic beverages on Sundays for off-premises consumption and the time the sale of alcoholic beverages may commence. The referendum may be presented as one question or as separate questions related to on-premises and off-premises consumption. If a majority of the voters voting thereon vote in favor of the question or questions, the sale of alcoholic beverages as authorized in this section on Sunday may be provided for by the city council.
(c) The referendum shall be held at the next regular municipal election or at a special municipal election called for that purpose by the city council. Costs of the referendum shall be paid by the city. A second or subsequent referendum shall not be held within 12 months following a referendum which fails to be approved by the voters of the city or to further authorize the sale of alcoholic beverages on Sunday pursuant to this section.
