§ 23-10-420. Notice to consignee of arrival of freight — Penalty for failure to give

(a)
(1) Within twenty-four (24) hours after the arrival of a shipment, railroad companies shall give notice by mail or otherwise to the consignee of the arrival of the shipment, together with the weight and amount of freight charges due thereon.
(2) Where goods or freight in carload quantities arrive, the notice shall also contain identifying numbers, letters, and initials of the cars, and, if transferred in transit, the number and initials of the car in which originally shipped.

(b) Any railroad company failing to give such notice shall forfeit and pay to the shipper or other party whose interest is affected the sum of five dollars ($5.00) per car per day or fraction of a day's delay on all carload shipments and one cent (1¢) per one hundred pounds (100 lbs.) per day or fraction of a day on freight in less than carloads, with a minimum charge of five cents (5¢) for any one (1) package, after the expiration of the twenty-four (24) hours. However, not more than five dollars ($5.00) per day shall be charged for any one (1) consignment not in excess of a carload.
