As used in this act [42-2-1 to 42-2-16 NMSA 1978], "state" includes any commission, department, institution, bureau or agency thereof as well as all political subdivisions of the state.

State highway commission (now state transportation commission) authorized by legislature to acquire property. — The state highway commission (now state transportation commission) is a department of the state of New Mexico, and authorized by the legislature to acquire property for highway purposes. Acquiring land for county sewage disposal facility. — The governing body of a county has the power of eminent domain for the purpose of acquiring land for a county sewage disposal facility, including a sewage lagoon. 1963 Op. Att'y Gen. No. 63-75.
