The attorney general or a district attorney with jurisdiction over a matter shall enforce the provisions of the Indian Arts and Crafts Sales Act [30-33-1 to 30-33-11 NMSA 1978]. The New Mexico office of Indian affairs [Indian affairs department] and an authorized tribal prosecutor may assist the office of the attorney general or the district attorney in determining whether the provisions of the Indian Arts and Crafts Sales Act have been or are being violated. Either the attorney general or a district attorney with jurisdiction over a matter may take action to enforce the provisions of the Indian Arts and Crafts Sales Act.

The 1991 amendment, effective June 14, 1991, added "or district attorney" in the catchline; inserted "or a district attorney with jurisdiction over a matter" in the first sentence; rewrote the second sentence which read "The New Mexico commission of Indian affairs shall assist the office of the attorney general in the determining whether the provisions of the Indian Arts and Crafts Sales Act have been violated"; and added the final sentence.
